1. Agreement to Terms
By accessing or using the website of Canyon Building & Design, L.L.C. ("Company," "we," "us," or "our"), or by engaging our construction services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.
2. Description of Services
Canyon Building & Design, L.L.C. provides professional construction services including but not limited to:
- New construction projects
- Renovation and remodeling
- Design-build services
- Commercial construction
- Additions and expansions
- Consultation services
Specific services and terms will be detailed in individual project contracts.
3. Project Agreements
All construction projects require a separate written contract that includes:
- Scope of work
- Project timeline
- Payment terms and schedule
- Materials and specifications
- Warranty terms
- Change order procedures
4. Payment Terms
Payment terms are specified in individual project contracts. Generally:
- Deposits may be required before work begins
- Progress payments are based on project milestones
- Final payment is due upon project completion
- Late payments may incur interest charges
5. Change Orders
Any changes to the original scope of work must be documented in writing through a change order. Change orders will include:
- Description of changes
- Cost adjustments
- Timeline impact
- Client approval signature
6. Warranties
We warrant our workmanship in accordance with the terms specified in your project contract. Warranty coverage:
- Workmanship warranties are specified per contract
- Material warranties follow manufacturer terms
- Warranties do not cover normal wear and tear
- Warranties are void if work is altered by others
7. Limitation of Liability
To the maximum extent permitted by law, Canyon Building & Design, L.L.C. shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or revenue
- Delays caused by factors beyond our control
- Damages exceeding the contract value
8. Client Responsibilities
Clients agree to:
- Provide accurate project information
- Obtain necessary permits and approvals (unless otherwise agreed)
- Ensure site access for workers and equipment
- Make timely payments as agreed
- Communicate any concerns promptly
9. Termination
Either party may terminate a project contract according to the termination terms specified therein. Generally:
- Written notice is required
- Payment for completed work is due
- Reasonable costs for materials ordered may apply
10. Dispute Resolution
In the event of a dispute, parties agree to attempt resolution through:
- Direct negotiation
- Mediation (if necessary)
- Binding arbitration (as a last resort)
11. Governing Law
These Terms of Service shall be governed by the laws of the State of Arizona. Any legal actions shall be brought in the courts of Pima County, Arizona.
12. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted on our website. Continued use of our services constitutes acceptance of modified terms.
